From 2016, head of the LAS Mtskheta-Mtianeti Legal Aid Bureau defended interests of the accused woman N.S. on the basis of the compulsory protection. She was accused of committing the crime envisaged under article 360 (arbitrary behavior) of the Criminal Code of Georgia.
According to the prosecution, the conflict started on the basis of the disputed land plot. N.S. argued her right on K.B.’s land plot which is bordered by the territory of the accused. In December, 2015, N.S. hired a tractor and damaged two posts which marked the land plot.
The blame was grounded on the minutes of questioning of the victims and witnesses, expert conclusions and investigation experiment minutes. Mtskheta District Court obliged the accused to pay the bail in the amount of 1000 GEL.
At the investigation stage, the public lawyer – Aluda Buchukuri inspected the land plot himself, took photos, and attached it to the investigation records. He also questioned the investigators and submitted all evidences to the court.
During the trial on merits at Mtskheta District Court, the defense party made a focus on the fact that the investigation was not conducted completely and impartially, doubted credibility of testimonies and evidences. The public lawyer demanded acquittal for the defendant N.S. and underlined that the case belonged to the civil law not criminal law.
Mtskheta District Court fully shared the position of the defense party and found the accused N.S. not guilty.
